The Financial Industry Regulatory Authority (FINRA) announced Tuesday that it has barred two brokers for wrongfully converting $300,000 from an elderly widow with diminished mental capacity and then failing to cooperate with FINRA’s investigation.

In barring Fernando L. Arevalo and Jimmy E. Caballero from the securities industry, FINRA found that between April and July, the elderly widow deposited approximately $300,000 in proceeds from the sale of two annuities into a bank account Arevalo had opened for her.

The funds were then withdrawn from the account via two cashier’s checks, and on the same day, Caballero deposited the money into a joint account he opened in his name and the widow’s name at a different bank, FINRA says.

When the bank questioned the deposits and required further confirmation before clearing them, Arevalo drove the widow to the bank to confirm the source of the funds. “Funds from the account were then depleted through numerous checks payable to Arevalo and Caballero,” FINRA says, with Arevalo using the account’s debit card for personal expenses including payments on a real estate loan, car loan and various retail purchases.

This merchandise group includes decorative accents, lamps, vases, dried and artificial flowers, baskets, ceramics, dinnerware, bath and fragrance products, candles, seasonal and gift items.

Furniture

This merchandise group consists of furniture and furniture cushions to be used in livin! g, dining, office, kitchen and bedroom areas, sunrooms and on patios. Also included in this group are wall decorations and mirrors. These goods are imported from a variety of countries such as Vietnam, Malaysia, Brazil, Thailand, China, the Philippines, India and Indonesia, and are also obtained from domestic sources.     We have long been bullish all things housing and the theme has paid off for readers quite well. It did not get past U.S. though that Pier 1 Imports (PIR) had disappointing numbers yesterday which caused the shares to decline by nearly 14% and volume to spike to 14.6 million shares. The company is still seeing sales growth, but this quarter saw a miss versus Wall Street's consensus numbers. During the conference call management said that the sales issue and profit miss was caused by mismanagement of their advertising which caused store traffic to come in light and forced them to discount merchandise later in the quarter...obviously at steeper discounts than if they had held the sales earlier in the quarter. Full year guidance was lowered, but we are willing to take the same stance here as we did with Bed, Bath & Beyond...a wait and see approach. Still bullish the home goods retailers.

    Campbell comes to AmEx from McKesson (NYSE: MCK  ) , where he served as executive vice president and CFO. He joined McKesson in 2003. His former employer said in a press release that it will replace him on an interim basis with its Vice President and Controller, Nigel Rees.
